Terms of Service

1. Parties

These Terms of Service (“Terms”) govern your use of the Charon Gate service (“Service”) provided by Obsidian Dynamics Limited(Company No. 16663833) (“we”, “us”, “Obsidian Dynamics”), registered at Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset BH16 6FA. By creating an account you agree to these Terms.

2. The Service

Charon Gate provides webhook ingestion, dead-letter queuing, retry delivery, and replay infrastructure (“Service”). We provide the Service on a best-efforts basis subject to these Terms and any applicable fair-use limits.

3. Acceptable use

You must not use the Service to:

• Transmit unlawful, harmful, abusive, or fraudulent content.
• Intentionally overload, disrupt, or interfere with the Service or other users.
• Attempt to gain unauthorised access to systems, networks, or data.
• Violate any applicable law or regulation.
• Relay malware or facilitate phishing attacks.

4. Your data

You retain all rights to the webhook payload data you transmit through the Service. You grant us a limited licence to store, process, and forward that data solely to provide the Service. We do not sell your data to third parties. See our Privacy Policy for full details.

5. Accounts and security

You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately at [email protected] if you suspect any unauthorised access.

6. Billing and payment

Paid plans are billed in advance on a monthly or annual basis via Stripe. Fees are non-refundable except as required by law. We reserve the right to suspend access if payment fails after a 7-day grace period.

7. Service availability

We aim for high availability but do not guarantee a specific uptime SLA on free-tier plans. We will endeavour to notify users of planned maintenance in advance. We are not liable for losses arising from Service outages beyond the fees paid in the affected billing period.

8. Intellectual property

The Charon Gate software, branding, and documentation are owned by Obsidian Dynamics Limited. Nothing in these Terms grants you any licence to our intellectual property beyond the right to use the Service as described herein.

9. Termination

You may cancel your account at any time from the Settings page. We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity. On termination, your data will be deleted within 90 days.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service shall not exceed the fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these Terms

We will notify users by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance. The current version is always available at this URL.
